MEETING
CITY OF WALKER
BUILDING CODE BOARD OF APPEALS
Thursday, November 16, 2006
7:00 p.m.

The meeting of the Building Code Board of Appeals was called to order by Tom Byle, Chairman at 7:00 p.m. at City Hall 4243 Remembrance Rd., NW, Walker, Michigan.

Members present: Tom Byle, Chairman; Dennis Bass; Charles Brown; and Robert Beaudry. Members absent: Randy Smith; and Vernon Farmer, Alternate. Also present: Jeff Nelson, Building Department; John Stuyfzand, Building Dept.; and Bonnie Antcliff, Recording Secretary.

DECISION AND ORDER

Legal Description

Property located at 3378 3 Mile, NW also known on the tax rolls as 41-13-08-226-004. Hearing requested by Wolverine Building.

The applicant’s request is to construct an addition to existing facility for Fed Ex Ground 54 ft. from the property line instead of the required 60 ft. for an unlimited area building.

Finding of Facts

Tom Byle, Chairman reviewed the application and site plan submitted. No other citizen appeared with respect to this request.

Jeff Nelson explained to the applicant that in order for this request to be granted, the applicant will have to have three of the four board members vote in favor of this since there were only four members present.

The applicant opted to go on with the hearing.

Mr. Ziegler, Wolverine Building stated that we want to add some office space here and as we proceed to the east we get further away from the property owned by Strain Electric. It is being used as a storage area. He does not feel this is an unreasonable request.

Jeff Nelson stated that back when unlimited area buildings were first allowed, everything had to be non-combustible in an unlimited area building. The Fire Department felt that 30 ft. was enough area for them to work around in a building that was sprinkled and there was no fire load inside to speak of. The Code felt that was too restrictive and when they adopted the Michigan Code, they do now allow for a certain amount of combustibles in an unlimited area building. The trade off was to move the building 60 ft. from the property line because the fire load could be greater. Basically the building that is there now, was built to the 40 ft. but they could have gone to the 30 ft. at the time and the addition be built the same way with non-combustible material. That is what the applicant is proposing to do.

Tom Byle, Chairman reminded the Board that to approve this, we have to find it better than, equal to, or that the present Code does not apply.

Dennis Bass asked if this was basically a steel and concrete building?

Mr. Ziegler replied that it is a pre-engineered building. They will cover the metal with dry wall and there will be a sprinkler system installed.

Bob Beaudry asked what this addition will be used for?

Mr. Ziegler replied it will be mainly office use. He went on to say that any cross walls will be metal stud.

Jeff Nelson stated that he talked with the Fire Marshall, and the Fire Department has no problem with this request.

Motion

Dennis Bass moved and Bob Beaudry supported the motion to grant the applicant’s request to construct an addition to existing facility for Fed Ex Ground 54 ft. from the property line instead of the required 60 ft. for an unlimited area building. The building to be non-combustible with the reduced setbacks as allowed under the previous building code.

Motion carried 4 to 0.

Motion

Dennis Bass moved and Bob Beaudry supported the motion to adjourn the Building Code Board of Appeals meeting at 7:20 p.m

Motion carried 4 to 0.
