The meeting of the Mineral Mining Review Board was called to order by
Steve Versluis, Chairman at 2:00pm in the Commissioner's Chambers, 4243
Remembrance Rd., NW., Walker, Michigan.
Members present: Steve Versluis, Chairman; Scott Conners; Darrel
Schmalzel; Gary Voogt; and Mark Koning. Also present: Jeff Nelson,
Building Official; Dick Denney, Deputy Building Official; and Bonnie
Antcliff, Recording Secretary.
DECISION AND ORDER
Motion
Darrel Schmalzel moved and Scott Conners supported the motion to
remove 700 Maynard from the table.
Motion carried 5 to 0.

Finding of Facts
Brent DeRose of Nederveld Associates appeared on behalf of Shoemaker
Aggregates.
Jeff Nelson stated that the applicant has submitted a new site plan
showing a one on five slope on the north side of the mining operation.
Pat Goodale is concerned about illegal fill. He wants the dirt on the
site to be used with none brought in from off site.
Scott Conners replied that clean fill is legal and it would be
illegal to bring in contamined fill from off site.
Gary Voogt stated that the plan shows it needs 48 ft. of fill to get
the proper slope and that is a lot of fill.
Brent DeRose stated that a one on three slope would be ideal but
since Shoemaker and Goodale could not reach an agreement they are going
to make it a one on five slope which fulfills the ordinance
requirements. He felt that perhaps in the future they could come to sort
of agreement and go back to the one on three slope.
Gary Voogt suggested that this could be filled this year.
Bob Shoemaker replied that he cannot possibly get this whole thing
filled this year besides he has a lease until 2007.
Motion
Darrel Schmalzel moved and Scott Conners supported the motion to
grant the Mineral Mining license for 700 Maynard until February 28,
2004.
The Board imposed the following condition:
1. A key to the site be provided to the Building Dept. to enable them
to do inspections on the site.

Finding of Facts
Jeff Nelson stated that the only condition imposed last year was that
a sign be placed at the entrance to the pit with the address on it to
make it easier to find the site. That has been done.
Brad Rahn stated that they have 26 acres that they are going to be
mining at this site. This is a part of the Millennium Park project and
they have 3 years to complete this. At the present time most of the
mining has been above water and in another year they will be digging
into the water and developing a lake for the park. He stated that he is
not fully aware of what the end use will be in this area.
Darrel Schmalzel stated that there was some concern about the grading
on the west side of the site and possibly there might be some soil
erosion problems here.
Mark Rambo replied that he went out to the site and was comparing the
stream bed at Butterworth and Maynard and the stream bed is pretty
stable without much sedimentation but as you move past the pit in the
southwest corner, it has been excavated pretty close to the channel. He
felt the area should be protected with sediment control and natural
grading will also help.
Brad Rahn assured the Board that this will be taken care of.
Darrel Schmalzel asked how long the applicant will be mining here
before the Park is here?
Mr. Rahn replied they will be there until December 2005 so it will be
3 more years. It may be sooner than that.
Scott Conners asked what the proposed grades are going to look like
in this proposed mining area? Will it be under water?
Mr. Rahn replied that hopefully it will be under water but he is not
100% sure until some of it is cleared off and they start digging in the
water. He went on to say that the County at one point was talking about
developing some wetland areas but he is not sure that is still the plan.
Scott Conners stated that we should get a map from the County and
attach it to this application as the end use plan because this plan does
not show any proposed contours. This is a unique project because it is
going to be under water.
Mr. Rahn stated that he will get a plan from the County.
Gary Voogt asked if everything is going to be pulled out of here and
what about the gas wells?
Mr. Rahn stated that the oil tanks etc. is beyond our control. If the
oil wells are left there, there will have to be access to them. So we
will not be able to dig there and there will not be water all the way
around them. He went on to say that he did not know what the County has
planned for the area.
Gary Voogt stated that he could not see from the site plan what they
intend to mine. There is no grading on the plan.
Mr. Rahn stated that they have it shown on the map where the mining
area is going to be. Within those lines is where we intend to mine.
Gary Voogt asked what are you going to mine to? The oil and gas wells
are in there at a 600 elevation.
Mr. Rahn stated we will be mining around them and we have to leave
access to the wells.
Gary Voogt replied that the existing contours are already 600.
Mr. Rahn replied that he did not know how much water they were going
to have as far as depth because of where the clay lies.
Gary Voogt stated that if you are going to mine to 600 and the water
is at 593 you are going to be 7 ft. above the water and not creating a
lake. He went on to say that he could not tell what the applicant was
going to do by looking at this plan.
Mr. Rahn stated that he could not come up with a plan on what the
County wants to do.
Scott Conners stated that he would like to see a reclamation plan
attached to the site plan with the end use and approximate contours. The
County should have that. We are required to have a reclamation plan with
all mining plans. There should be two sheets here, one is what you are
going to mine out and one is what you are going to leave behind.
Mr. Rahn replied that he will get the reclamation plan on what the
County has and that is the best he can do.

the public hearing.

Darrel Schmalzel stated that the plans for Millennium Park are moving
right along. The Planning Commission has approved the site plan for
Phase 1 (a) and Phase 1 (b) which takes in a lot of this site but does
not go this far west yet so there are no plans on that end of the site.
The parking lots are already in on Phase 1. It is a work in progress.
Motion
Scott Conners moved and Gary Voogt supported the motion to table the
application for a Mineral Mining license and extend the Mineral Mining
license for 30 days.
The Board imposed the following conditions:
1. Reclamation plan from the County be attached to this application.
2. Soil erosion plan for SW corner of this site.

Brent DeRose of Nederveld Associates appeared on behalf of Velting
Contractors.
Jeff Nelson stated that the conditions from last year were:
1. The sign at the entrance needs to be repainted and have a visible
street address.
2. Re-grade or clean out the sediment traps near Walker Ave.
3. Add stone or crushed concrete to the channels that are forming
along the access drive.
4. Asphalt access drive needs to be swept and maintained.
5. The asphalt drive must be used as the exiting point for the site.
The dirt ingress access drive appears to be used for both purposes.
6. Silt fence needs to be installed along south eastern perimeter by
the fill piles.
7. Wetland delineation needs to be performed on the south end of the
site.
8. Blue foam and all unsuitable fill material needs to be cleaned off
of site.
He went on to say that the blue foam was not present when we were
there the other day. He stated that one thing that disturbs him is that
this is one of the few sites that is actually in an industrial district.
You have granted them a permit for crushing concrete but when we were up
there this week, it looked like there was chimney material there such as
chimney liners, chimney bricks, and he did not feel that materials like
that should be dumped at the site.
Mr. DeRose pointed out the site plan and stated that last year we
mined in the central area of the site and as the area flooded we would
head up to the northwest corner of the site. He pointed out the
reclamation area. We are going to continue mining in the central area of
the site and as it floods out we head back up to the northwest corner.
This process material is pretty large right now but that will be
leaving. He stated they will look into the area with chimney parts. That
area will have to be addressed. The low area on the south part, the
wetland that was requested last year, there is an area here that has
been graded away from that. Mr. Velting is going to take care of the
wetland to make sure that no sediment gets into that area.
Mark Rambo stated that following last year's meeting he met with
Scott Velting and we waived the delineation on the south end of the site
because we were in agreement that this was a wetland there. We walked
the site along the access drive on the south and there were a few points
were there was a discharge to the wetland area. They regraded those
areas so it would drain into itself. He felt the site was pretty
contained and felt comfortable approving the site. Scott Conners
prepared a document that will ensure that if any discharges occur to the
wetland, then they will be addressed immediately. It does include a
maintenance and inspection cycle. If there is anything that involves the
wetlands, it will involve the DEQ approval.
Scott Conners asked what they did with the area near the process
material and storage area to see that it did not drain into the
wetlands.
Mr. DeRose replied there were berms installed and then they graded
back into the mining site. There is also a vegetation buffer between the
haul road and the wetland.
Scott Conners replied that they should make sure that gets on the
plan for the next time.
Gary Voogt asked if the concrete was coming in from Kloet? It looks
like it is dumped off on top of the hill and falls down into the pit.
Brent DeRose replied it is dumped off at the top of the hill but it
is brought in off from Walker.
Gary Voogt asked if this was a sand pit or a recycling center? He
stated he did not see much change in sand for the past several years.
Brent DeRose replied that there has not been a significant amount
taken out this past year. This site is to be complete by 2007.
Gary Voogt felt that this is a good spot for a concrete operation.

Scott Conners moved and Darrel Schmalzel supported the motion to open
the public hearing.

Irving Miller 2118 Blue Bell Way wants to know what is going on here.
Steve Versluis explained to Mr. Miller what this hearing was for and
what the mining operation is.
David Chamberlain 2041 Blue Bell Way stated that he is concerned
about the noise from the site and hours of operation. He also felt that
mud and dust should also be controlled.

Gary Voogt moved and Mark Koning supported the motion to close the
public hearing.

Darrel Schmalzel stated that this site is zoned industrial and is
master planned for industrial and the long term plan from the City's
point of view is to extend Kloet Ave. through this property to Walker
Ave. Someday it could be developed as industrial as it is currently
zoned. That could be subject to change but right now the plan for this
property is for industrial future land use.
Brent DeRose stated that the asphalt drive is being used now. They
were using the drive on the south but are now going up the asphalt
drive.
Gary Voogt felt the asphalt drive should be cleaned up. It is getting
bad.
Scott Conners felt that there is a lot of steel and uncyclable
materials here. We need to stop that.
Brent DeRose stated that there is going to have to be better
monitoring of the materials that are brought in here. There is a lock on
the gate and fence across it. It was probably left open and someone came
in there and dumped unauthorized materials. He went on to say that they
will have to make sure it is locked so no dumping can occur.

Scott Conners moved and Gary Voogt supported the motion to approve
the Mineral Mining license for 2200 Walker until February 28, 2004.
The Board imposed the following conditions:
1. The dirt drive be permanently blocked off and closed prior to the
mining season.
2. Name be placed on the sign to the site.
3. Bond or letter of credit needs to be renewed by March 1, 2003.
4. A key to the site be provided to the Building Department to enable
them to do inspections on the site.

Brent DeRose of Nederveld Associates appeared on behalf of Diversco
Const. Co.
Jeff Nelson stated that the condition from last year was that we
receive a new restoration plan with more detail and we did receive that,
also:
1. The percolation basin seems to be non-functioning and there should
be some kind of calculation submitted to make this function.
2. The area west of the entrance drive was to be reclaimed by June 1,
2002 and currently there is standing water there and none of it has been
reclaimed.
3. Open face behind house was labeled to be reclaimed by June 1, 2002
and that has not been touched.
4. There is no address on the entrance sign.
Mark Rambo stated that last year there was a lot of standing water on
the site and that was the main issue. There was a retention area that
was dug but the way it was put in, no actual water could shed into it
from around the edges and that has since been taken care of. We talked a
lot about putting in a detention basin at last year's meeting and that
for the most part has been installed. It does appear adequate and there
is very little water on site if any.
Brent DeRose pointed out the site plan with explanations. The basin
was dug late in the year so we were not able to construct the outlet
pipe so this basin is sized to Kent County Drain Commission standards.
The area north of there has been seeded and it will be completed this
year. A good portion of area along Butterworth has been stabilized and
is looking good. There is still sand on the east that needs to be mined
and they are going to go as far as they can and then should be pretty
much mined out. Then a full reclamation plan will go into effect.
Dave Maas stated that last year we had a lot of discussion on the
detention basin that was to be designed and installed and where we were
going to mine. We have done pretty much what we talked about last year
as far as the mining and as far as the basin, we built it late last
fall. We do have the pipe out of the basin to the right-of-way and we do
have to cross Butterworth yet this season and we can do that the first
thing in the spring. We hauled a lot of fill in the east side and
started building that slope back out. We have put it back in as a one on
five. We will be hauling sand out and material in again this year. He
stated that they did pretty much what was talked about last year. This
year will be ongoing. He felt there was probably about two years left at
this site.
Scott Conners stated that he met Arne Larsen of Nederveld at the site
last year. He felt there was a proposed path laid out for the pipe there
at that time and it still is not done. It also looks like there is more
fill to go in here than there is sand to come out. The area behind the
teepee and the two houses along Butterworth does not look like it is to
be relaimed this year and he thought it was to be reclaimed last year.
It is the area that we talk about every year and every year we say we
will try to get an agreement so they can go one on three and some of the
sand on lot 003 will be mined out, and every year we come in and there
is no agreement and no action. We are almost done with the project with
just a small amount of sand to go and we are left with a huge steep
slope here with no material to support it.
Dave Maas replied that he disagrees with that because we had a steep
slope on the east side of this exception and that has been pretty much
filled in this past year. He stated that his intention was to fill this
in all the way around but it takes time to do it. We are always looking
for areas to fill so that is a good thing. It is no problem for us to
bring in material. We have demonstrated that on the east side this past
year. He went on to say that he knows we have been talking about this
for the past five years but it is not a one year deal, it is an ongoing
thing until the mining is done and probably a year after that. We had a
buy-sell agreement with the County and they were interested in buying
this property to make an exchange with Hunderman. Once that happened, we
were not sure if this was actually going to go in the way we had talked
about it so we held off for awhile. Now it is gone by the wayside so we
went in and put the basin in the way it was designed from the beginning.
The fact that the pipe did not get across Butterworth is because the
weather got bad before we could finish. The basin is built, the pipe is
across the entrance drive, and the pipe is stubbed out to the
right-of-way so we are talking about one day to lay the pipe across
Butterworth once the asphalt plants are open.

Finding of Facts
Jeff Nelson stated that the conditions from last year were:
1. The crushing operation not to be expanded.
2. Bond or letter of credit submitted to the City.
He went on to say that in the past he has been very much against the
crushing operation of material brought into an agricultural site. He
felt that it should be eliminated in agricultural districts.
Brent DeRose of Nederveld Associates pointed out the site plan. The
mining operation is on the north side. It is pretty much the same spot
as shown last year. There is a little material left there yet. Some of
the area off of Maynard has been filled in this year. We are going to
continue working here in the year to come. The crushing has not expanded
in this past year. The intent is to keep it about the same size.
Scott Conners asked if this was really a mining operation here? It
seems they take out just enough to call it a mining operation. It seems
to have taken on an industrial use--it is more a crushing operation and
a place to dump fill.
Brent DeRose replied that the mining is winding down and there still
is a significant amount that needs to be filled on this site. The intent
is to keep the crushing operation.
Scott Conners asked if there was a timetable for turning this
property over to the County?
Dave Maas replied that there is nothing definite yet. If they buy the
property at some point they will want us to continue filling in areas
that needed filling and they will also let us crush concrete for a
period of time. It is all part of the negotiation and we do not have
anything definite at this point. We are still mining here. We feel there
is more gravel here yet and we want to get it all out before the County
comes in. We will also continue to bring in concrete and crush it. It is
an agricultural area but there have never been crops here and it has
always been an industrial use. It is no different than it has been for
the last 50 years and we are getting to the end.
Jeff Nelson stated that Hunderman & Sons is the new owner of
Riverside Gravel and asked if there is any mining going on in their
property?
Mr. Maas replied yes there is active mining on their property.
Gary Voogt asked if it was time to change the zoning on this site?
Jeff Nelson replied a concrete crushing operation of off site
materials has never been an approved use in an agricultural district.
Just because they started it without anyone's knowledge does not mean
that it was right in the first place.
Gary Voogt asked if this was going to be part of Millennium Park or
should this be industrial?
Dave Maas replied that we have talked to the County but this is all
it has been is talk. There is no commitment here. He went on to say that
he hoped the County would work around them but did not feel that was
realistic.
Darrel Schmalzel stated that he felt that the County's long range
plan was to include everything south of Butterworth to the river
including this property. There is not an agreement yet on a lot of these
parcels. It is a 20 year vision.
Dave Maas stated that the crushing operation is critical to their
business.
Steve Versluis stated that this is a good place for a crushing
operation. It is not a nuisance, it does not offend anyone, people are
not complaining about the dust and in many respects it is an ideal
location as opposed to up on Walker at Triick's where there is a
development taking place to the west. Recycling seems to be a wise
operation. Instead of putting this in a landfill we are bringing it back
as a viable commodity. He felt this is a good thing to do at this
location.
Scott Conners stated that he agreed with Jeff. We have allowed the
County across the street to build a parking lot and they are building
pavillions and restrooms. This is going to be a park by June or July of
this year and they want to get truck traffic off of this road. There are
some competing uses here that are going to come to a head here pretty
quick. We are looking at an operation here that will continue to bring
trucks even though the mining is pretty much ceased. The only reason
that we can call this an active mining area is because we are adding
property to the north on the Hunderman site to be able to say that there
is gravel on this site. This use is going to be a problem for the City
real quick.
Steve Versluis felt that perhaps the material that Mr. Maas crushes
will be brought across the street to build their pavillions and
construct their roads for Millennium Park.
Darrel Schmalzel asked if there was a non-conforming status of the
crushing operation?
Jeff Nelson stated that he was not aware there was a crushing
operation here until the sign went up saying material could be brought
in. This is not mining minerals that are on the site. There are others
down the street that want to do the same thing because someone else is
doing it.
Scott Conners stated that he also felt this was an ideal site for
this but 6 months from now he does not want to choose sides. He felt the
Board should get an opinion from the City Attorney and it should go to
the Zoning Board.
Darrel Schmalzel stated that if it is an existing non-conforming use
and it was legally established, he did not feel it was this Board's
right to tell them that they could not do it.
Jeff Nelson replied that to be a non-conforming use, they would have
to prove that they were a conforming use at one time.
Dave Maas stated that he felt that Millennium Park would have a
problem complaining about what is going on across the street when they
will be mining for the next 3 years on their own site. He stated we have
been crushing concrete here for over 10 years. We were mining gravel
here before Walker was a City.
Gary Voogt stated that he did not feel there was a problem to be
solved here. He did not feel it should go to the Zoning Board. He felt
it should be left alone.

Scott Conners moved and Gary Voogt supported the motion to open the
public hearing.

Brad Rahn from Grand Rapids Gravel stated he would like to see
Gillisse continue to crush gravel here but that he had a similar request
a few years ago and the Board denied them to do the same thing.

Scott Conners asked Jeff Nelson what his recommendation would be?
Jeff Nelson replied that they can crush on site material but they
cannot bring in off site material unless it is an industrial district.
They would have to go to the Board of Appeals to do this.
Darrel Schmalzel stated that he was comfortable with the conditions
used in the past that the activity is not to be expanded. We have been
fortunate that it has not been taken advantage of.

grant the Mineral Mining license for 1400 Maynard until February 28,
2004.

Brent DeRose of Nederveld Associates appeared on behalf of James

Jeff Nelson stated that the conditions from last year were:
1. Signatures be obtained from the 2 missing property owners by March
31, 2002. If that does not happen we will revert back to the original
reclamation plan and the reclamation on the north side of the site,
which was required last year, would have to be done prior to July 31,
2002.
2. Address be shown on the site entrance sign.
3. Percolation basin be located south of the entrance drive as
necessary in the field.
4. Fence should be up and certified with no trespassing signs before
the application is approved.
Mark Rambo stated that he did not see any problems at this site.
Brent DeRose stated that last year we were working off to the west
and southwest trying to clean up the area that is adjacent to the Sandco
Pit. We will continue along this face until we run out of sand and then
get to the reclamation plan. Hopefully that will correspond to what
Sandco is doing. The two property owners to the north have joined on the
application so we are going to take the sand out of here. Right now it
is being cleared. Where we are showing the active face is where the
mining is going to begin. We are not going to be mining up against the
existing house. The area behind the existing house has been graded out.
There were a lot of trees in there and they were able to save most of
the trees.
Darrel Schmalzel stated that you show the SW area of the property to
be mined under the 2003 permit. It looks like it goes into the 30 ft.
buffer area that is required along the property line. That should be
adjusted and pulled back, nothing should be done within the first 30 ft.
of the property line.
Scott Conners stated that parcel 017, which is just north of the old
north boundary, looks like there is a reclamation contour of 650 and
looks like it wraps around the back. Underneath that there is a 700
contour. Is all that coming out?
Brent DeRose replied yes. It will not be all the way up to the top it
will eventually start coming back down. They are trying to do it that
way so that the equipment is not up against the house. The grade will be
relatively flat from the house back.
Motion
Darrel Schmalzel moved and Scott Conners supported the motion to open
the public hearing.
Motion carried 5 to 0.
Joe Taylor 3250 O'Brien is concerned about the fences. He feels the
material used is inadequate.
Steve Cordes stated that he has used heavy duty fence posts and has
put this at the active face going toward the southwest corner lot line.
There is a small area that is not fenced because we ran into a big vein
of clay at the top. We are trying to finish the corner by Sandco. We
have been working with Dave Maas. As far as the fence goes, we have
heavy duty fence posts holding the fence up. He stated he paced out 15
ft. for every post and then connected the fence with nylon ties. We
tried to make it as permanent as we could where we are not going to be
working. He stated there is a small area that needs attention and he
will take care of that. Sandco is more than welcome to use our driveway.
We left some of the pine trees behind Vaughn's property as a buffer
between Maynard and Butterworth.
Mike Sherrington 671 Maynard is concerned about what they are going
to do at the edge of the property. He stated that someone has been
surveying at the end of his property. He wanted to know the reason for
that.
Brent DeRose responded that no one has been out there that he knows
of.
Steve Cordes stated that the site looks bad right now because the
logging has just been done. He went on to say that we plan to clean it
up but it will take time to do it.

Scott Conners moved and Darrel Schmalzel supported the motion to
close the public hearing.
Motion carried 4 to 0. (Mark Koning had to leave.)
Mark Rambo asked if all the neighbors are shown on the site plan? He
felt that all properties should be shown on the site plan.
Brent DeRose stated we can show the boundaries from a tax map. Next
year it will be done with property owner's names. There is a new fence
up there with very clear no trespassing signs up all along the fence.
Gary Voogt stated that the grading plan shows modest slopes here but
it will take time to get it all finished.

Scott Conners moved and Steve Versluis supported the motion to
approve the Mineral Mining license for 731 Maynard until February 28,
2004.
The Board imposed the following conditions:
1. The fence to be reinstalled with letter of certification from the
engineer to the Building Department.
2. A key to the site be provided to the Building Dept. to enable them
to do inspections on the site.
Motion carried 4 to 0.

Gary Voogt moved and Darrel Schmalzel supported the motion to approve
the Mineral Mining minutes of February 10, 2003.

the Mineral Mining meeting at 4:45pm
