MEETING
CITY OF WALKER
MINERAL MINING REVIEW BOARD
Tuesday, February 19, 2008
3:00 p.m.

The Mineral Mining Review Board was called to order by Scott Conners, Acting Chairman, at 3:00 p.m. at City Hall, 4243 Remembrance Rd., N.W., Walker, Michigan.

Members present: Scott Connors; Frank Wash; and Bonnie Broadwater. Members absent: Steve Versluis, and Mark Koning. Also present: Tim McGladdery, Building Dept; and Bonnie Antcliff, Recording Secretary.

DECISION AND ORDER

Goodale Sand Pit has requested approval for a mineral mining license.

Property located at 700 Maynard, SW, 41-13-33-200-014 & 41-13-33-326-010.

Finding of Facts

Brent DeRose stated that at the last meeting we went over the plan and what we are planning to do for 2008. The original lease with Shoemakers and the VanDams has run out and now it has gone back to the Goodales. We have a tentative agreement with Meekhof to continue mining sand here. He then pointed out the site plan and showed where they plan on mining in 2008. He stated that at the last meeting the Board wanted to have more information on the phasing and what we are going to do. We have a tentative time frame for the next 6 years. Phase 1 will be in the southeast corner, and Meekhof is not quite there yet. We will work around the well. We will continue to work to the north and reclaim the floor as we go. Phase 2 will be in the northeast corner and that will be in another 6 years. Phase 3 will be closing out the pit and we have until 2025 to do that. This site drains in 3 different directions. Some of it comes from the old Demolition Pit and some of it comes through the sedimentation basin and Flossie’s pit and some goes through the Meekhof pit. We added some flow arrows on the plan to show what we are planning to do. On the floor of the basin we are going to dig another percolation basin and berm it. There are not really any drainage problems on this site. We continue to mine to the north and everything just falls back into the pit. There is no issue in it running to the north. There is a swampy area here and we will be happy to do a wetlands determination when we get close to that area. We do want to leave both accesses open to the haul road. The access to the west is going to be needed so that Shoemakers can come in and reclaim their section of it, so the next year that will definitely need to be open. Once Meekhofs start, he is going to come in from the east and attack Phase 1 & 2. Ultimately we plan on moving out to the west and the rational is for the shortest haul distance. We do propose using both access roads. We have a note added to the plan about the type of fill material that will be hauled into the site. That is #12 on the plan. That will be inert material.

Frank Wash stated that in Phase 1, the reclamation contour of 688 is like an 80 ft. drop and that is a lot of sand to come out of there.

Brent DeRose stated that we are looking right now at 80 ft. of exposed bank. That 692 elevation is about a clay seam that Shoemakers ran into as they were mining on this site.

Scott Conners asked if there was any agreement about the westerly drive that goes through the Demoltion property?

Mr. DeRose replied that the Goodales now own that property. He went on to say that there is a lot of clay up along Butterworth and they intend to regrade that and smooth it off and reclaim the open faces that are on that pit.

Scott Conners asked what are you planning on doing with this site long term?

Pat Goodale replied that we are going to develop it and put housing on it but that is long way off.

Frank Wash stated that on the Demolition Pit there was a plan that was denied in 2001 and then the owners were given the option to either reclaim the site or continue mining. There was no minable material on this site so it was dropped. So it was never reclaimed.

Brent DeRose stated that property is part of this application.

Pat Goodale stated that we plan on leveling that area out.

Scott Conners stated that there was a contractor there and an applicant that was committed to doing certain things like top soiling and seeding before he was done and they just walked away. We need to protect you, the property owner, who may have given permission to do some mining. We still need to work through that.

Pat Goodale replied that we own this property.

Frank Wash stated that we need to take the Demolition Pit into this permit and come up with a reclamation plan for it to finish out what should have been done by the Demotion contractor.

Mr. Goodale stated that we plan on reclaiming this.

Scott Conners stated that if you want to submit something as a revised reclamation plan that shows you have smoothed out the contours that are there, but most importantly top soiling and seeding everything within a reasonable time frame, that would be good

Brent DeRose stated that this year Bob Shoemaker has to go in and fulfull his section of this site to get it reclaimed and then next year we will come in with a reclamation plan on how we are going to stabilize that. The Demolition Pit is now part of this application.

Bonnie Broadwater stated that you have stated you are going to avoid the drainage channel to north. She went on to say that she would like to see you put some kind of buffer distance from the stream channel on the plan stating you are going to stay back so many feet. That should be clear. She stated she would like to see a wetlands determination before Phase 2 is started.

Frank Wash stated that we will need compaction tests done for any fill done in 2008.

Motion

Frank Wash moved and Bonnie Broadwater supported the motion to approve the mineral mining license for 700 Maynard until February 28, 2009.

The Board imposed the following conditions:

Goodales take responsibility for the reclamation of the Demolition Contractors’ site with reclamation proposed for 2009.

Wetland determination before Phase 2 is started.

Soil erosion permit be applied for with details on the erosion protection plan.

2008 filling compaction tests with 2009 mining application.

Motion carried 3 to 0.

DECISION AND ORDER

Gillisse Aggregates has requested approval for a mineral mining license.

Property located at 1400 Maynard, SW, 41-17-04-300-001, 41-17-04-100-002, 003, 007, 008, 009 & 41-13-33-376-016.

Applicant: Kent County Parks Foundation Owner: Same

Finding of Facts

Frank Wash stated that we have the letter from Kent County Parks that we requested at the last meeting regarding compaction requirements.

Dave Maas, Gillisse Aggregates stated that they added contours to the plan for this year. He then pointed out the site plan.

Scott Conners stated that the site plan should have an engineer’s seal on it.

Mr. Maas stated that we have a bond here but part of our agreement with the County is that they are keeping a third of our money until we get things done that are agreed to. He asked if it was still necessary to have the bond here and a substantial amount of money with the County?

Scott Conners replied he would have a hard time letting that go. He went on to say that he understood their position but we still require that from everyone else. He stated if the County was willing to take on the liability for not having a bond, he would be comfortable with that.

Frank Wash stated that the County now owns the property so they are responsible for anything that goes on there.

Scott Conners stated that if the County would tell us that they are comfortable taking on this responsibility, he would be ok with that.

Mr. Maas stated that our agreement with the County is that we will be completely done here by September 30, 2009. He stated that he will talk with County and see what they come up with.

Motion

Frank Wash moved and Bonnie Broadwater supported the motion to approve the mineral mining license for 1400 Maynard until February 28, 2009.

The Board imposed the following conditions:

Plans need to be sealed by an engineer.

A letter from the County accepting responsibility for reclamation instead of a bond.

Motion carried 3 to 0.

Motion

Bonnie Broadwater moved Frank Wash supported the motion to approve the mineral mining minutes of February 5, 2008.
