MEETING
CITY OF WALKER
ZONING BOARD OF APPEALS
Thursday, August 10, 2006
7:00 p.m.

The meeting of the Zoning Board of Appeals was called to order by Robert Marz, Chairman at 7:00 p.m. at City Hall 4243 Remembrance Rd., N.W., Walker, Michigan.

Members present: Robert Marz, Chairman; Roger Crabtree; Jay VanSoestberg; Charles Deshaine; Rebecca Haven; Ken Fex; and Tyler Korfhage. Also present: Jeff Nelson, Building Department; Dick Denney, Building Department and Bonnie Antcliff, Recording Secretary.

DECISION AND ORDER

Legal Description

Property located at 3290 Walker Ave. also known on the tax rolls as 41-13-03-100-031. Hearing requested by Faith United Church of God.

The applicant’s request is to install a monument sign 120 in. x 164 in.which exceeds the 6 sq. ft. allowed and the maximum height allowed.

Finding of Facts

Robert Marz, Chairman reviewed the application and site plan submitted.

Ms. Erika Irving appeared on behalf of Faith United Church stated that the original entrance has changed. So we are replacing a former sign. She stated that we had numerous comments on the former sign that "we did not see it." We are looking for a better way to make us more visible and also to give us an option for advertising special events. We need a sign that will catch peoples’ eye and we are looking for a sign that is larger than the former one we had. We would like an interior lit sign with the Church name above the message board. We are getting a lot of commercial around us.

Scott Urbane, Valley City Sign stated that this area is zoned Agricultural but the area is becoming very Commercial. Visibility is a big issue here. This is not a huge sign. If we go smaller it will not work. You will not be able to see it or read it. We designed it as small as we could and still be functional. If the area is going to be rezoned, what will it be rezoned to? The road out front has been redirected and they need a new sign.

David Vickery, 6386 Leigh High Ct. stated that he is a member of the church. This is becoming a commercial area and they need this sign in a changing area.

Ken Fex asked why the church was placed that far off the road?

Ms. Irving replied that they wanted a place near the expressway that had good visibility. There was a large parcel of land there available but we could not afford it. The property was split and we bought a portion of it.

Roger Crabtree stated that he would not like to see the electronic message board be a scrolling sign or that it not be a rapidly changing sign.

Jeff Nelson stated that no scrolling signs are allowed.

Ken Fex asked if the message on the sign will be on around the clock?

Ms. Irving replied that we want to advertise what we are doing and it will be 24 hrs. a day and 7 days a week.

Mr. Urbane stated that it could be dimmed at certain times of the day. It could run from 6:00 a.m. to 12:00 p.m.

Roger Crabtree asked if the sign was internally illuminated?

The applicant replied yes.

Motion

Charles Deshaine moved and Tyler Korfhage supported the motion to grant the applicant’s request to install a monument sign 120 in. x 164 in. which exceeds the 6 sq. ft. allowed and the maximum height allowed.

The Board imposed the following condition:

1. The setback should be a minimum 12 ft. from the property line.

There are exceptional or extraordinary circumstances applicable to the property in question as to the intended use of the property that do not apply generally to other properties in the same zoning district. The church had a house in front when it was built and we had to go to the back to build. We now need visibility.

The variance is necessary for the preservation and enjoyment of a substantial property right similar to that possessed by other properties in the same zoning district and in the vicinity. The adjacent properties around the church are commercial businesses and the church should be allowed similar signage.

Authorization of the variance will not be of a substantial detriment to adjacent property and will not materially impair the intent and purpose of the ordinance or public interest in that others in the area have signage. This sign will provide a community service with the electronic message units.

The condition or the situation of the piece of property or the intended use of the property for which the variance is sought is not so general or recurrent a nature as to make reasonably practicable for the formulation of a general regulation. The zoning should not change as it is a church.

Motion carried 7 to 0.

Motion

Ken Fex moved and Rebecca Haven supported the motion to approve the Zoning Board of Appeals minutes of June 22, 2006.

Motion carried 7 to 0.

Motion

Ken Fex moved and Tyler Korfhage supported the motion to adjourn the Zoning Board of Appeals meeting at 7:50 p.m.

Motion carried 7 to 0.
