MEETING
CITY OF WALKER
ZONING BOARD OF APPEALS
Thursday, August 24, 2006
7:00 p.m.

The meeting of the Zoning Board of Appeals was called to order by Robert Marz, Chairman at 7:00 p.m. at City Hall 4243 Remembrance Rd., N.W., Walker, Michigan.

Members present: Robert Marz, Chairman; Roger Crabtree; Beth Rogers, Alternate; Rebecca Haven; Charles Deshaine; Ken Fex; and Tyler Korfhage. Member absent: Jay VanSoestberg. Also present: Jeff Nelson, Building Department; and Bonnie Antcliff, Recording Secretary.

DECISION AND ORDER

Legal Description

Property located at 1106 Kenowa, SW also known on the tax rolls as 41-13-31-300-022. Hearing requested by Neil Meyer.

The applicant’s request is to move existing barn which is now located in the front and partial side yard to a new location which will be in the partial side and rear yard.

Finding of Facts

Robert Marz, Chairman reviewed the application and site plan submitted. No other citizen appeared with respect to this request.

Jeff Nelson stated that even though the barn is going to be relocated, it will still be in the side yard.

Neil Meyer stated that they had received a variance for the house in 1988. The barn is not safe anymore but they want to keep it by relocating it. The foundation is crumbling and the roof is getting bad.

Ken Fex asked if the applicant was going to use material from the present barn or will it be done from scratch?

Mr. Meyer replied that they want to preserve the character of the barn. We plan on turning the barn around so that the gable end faces the road. We plan on putting a footing and foundation up to ground level and using the original blocks for above ground. We will go 2 to 3 ft. above ground before we start to sidewall the barn. The siding has been taken off piece by piece. We would like to put the old bar siding up again but it will have a new roof structure on it. We also plan to use the old windows. The original barn was built in l918. He went on to say that the new barn will be at ground level and will not be as tall as it is now.

Roger Crabtree asked the applicant if he has checked with the State of Michigan on what can and cannot be done with this historic barn?

Mr. Meyer replied that this barn is not registered as historic with the State.

Roger Crabtree replied that he did not think it had to be registered. He felt that the State did have regulations on this and felt Mr. Meyer should check with the State.

Motion

Tyler Korfhage moved and Roger Crabtree supported the motion to grant the applicant’s request to move existing barn which is now located in the front and partial side yard to a new location which will be in the partial side and rear yard per site plan.

There are exceptional or extraordinary circumstances applicable to the property in question as to the intended use of the property that do not apply generally to other properties in the same zoning district. Power lines are 41 ft. to rear of house. Dimensions of relocated barn from front to rear is 54 ft. As barn would not fit in a location to rear of house and in front of power lines, the necessary location would need to be beside the house.

The variance is necessary for the preservation and enjoyment of a substantial property right similar to that possessed by other properties in the same zoning district and in the vicinity. 1. Mr. Jim Blauw, south of us, recently built a new house behind the power lines. 2. Our neighbor to the south has an accessory building (unattached garage) beside the house. 3. Neighbor to the north has an accessory building (red pole barn) beside the house.

Authorization of the variance will not be of a substantial detriment to adjacent property and will not materially impair the intent and purpose of the ordinance or public interest in that there will be no detriment to the neighbors.

The condition or the situation of the piece of property or the intended use of the property for which the variance is sought is not so general or recurrent a nature as to make reasonably practicable for the formulation of a general regulation. The ordinance should not have to be changed and this request will not be reoccurring.

Does not apply.

Recommendation:

The applicant should check with the State prior to starting the project.

Motion

Ken Fex moved and Rebecca Haven supported the motion to approve the Zoning Board of Appeals minutes of August 10, 2006.

Motion carried 7 to 0.

Ken Fex moved and Beth Rogers supported the motion to adjourn the Zoning Board of Appeals meeting at 7:30 p.m.

Motion carried 7 to 0.
