CITY OF WALKER
ZONING BOARD OF APPEALS
Thursday, April 12, 2007
7:00 p.m.

The meeting of the Zoning Board of Appeals was called to order by Robert Marz, Chairman at 7:00 p.m. at City Hall 4243 Remembrance Rd., N.W., Walker, Michigan.

Members present: Robert Marz, Chairman; Roger Crabtree; Charles Deshaine; Rebecca Haven; James Hickey; and Tyler Korfhage. Members absent: Beth Rogers; and Randy Smith.

DECISION AND ORDER

Legal Description

Property located at 2547 3 Mile Rd. also known on the tax rolls as 41-13-04-400-030.

The applicant’s request is to install two signs on existing industrial building which total an additional 165.36 sq. ft. on a parcel of land without any dedicated street frontage.

Finding of Facts

Robert Marz, Chairman reviewed the application and site plan submitted.

Craig Ellis, Appearance Products stated that the building is approximately 206,000 sq. ft. and it is 600 ft. long. The tenant wants to be noticed so they want this signage. The new sign will be lit. The sign will be spread out to center on the front of the building.

Jim Hickey asked how high are the letters going to be?

Mr. Ellis replied they will be 28 in. tall, the existing letters are 22 in tall.

Robert Marz asked if this had the proper street frontage, would it be legal?

Jeff Nelson replied it would depend on how much street frontage they had. If the building were all street frontage, they would be allowed l 1/2 ft. for every foot of street frontage so that would be quite a bit of street frontage they would be allowed. It is going to be changed and it will be based on the building itself.

Mr. Ellis stated that The Grand Rapids Press building is across the street and those letters are 16 ft. high. The letters we are asking to put up are 2 ft. high. This is as big as we can go on this building because of the rolled roof. It is a small sign for the size of the building.

Jim Hickey asked where will the sign placement be on the building? If someone rents another part of that building will they be able to put a sign up there?

Mr. Ellis replied that the sign will be centered on the space we occupy. The two signs would be 20 to 30 ft. apart and if a second tenant wants to put up a sign, another variance would be required.. This building was not designed to put a sign up on it. These will be neon channel letters on the building. Any sign with individual lit letters on a building are neon.

Chuck Deshaine moved and Roger Crabtree supported the motion to approve the request to install two signs on existing industrial building which total an additional 165.36 sq. ft. on a parcel of land without any dedicated street frontage.

The variance is necessary for the preservation and enjoyment of a substantial property right similar to that possessed by other properties in the same zoning district and in the vicinity. The building has no frontage on 3 Mile to calculate signage.

Authorization of the variance will not be of a substantial detriment to adjacent property and will not materially impair the intent and purpose of the ordinance or public interest in that the sign will face the highway and not interfere with any other existing buildings.

The condition or the situation of the piece of property or the intended use of the property for which the variance is sought is not of so general or recurrent a nature as to make reasonably practicable for the formulation of a general regulation. This will not be repetitive in that the ordinance should be changed.

Motion carried 6 to 0.

Election of Officer

Roger Crabtree moved and Chuck Deshaine supported the motion to nominate Tyler Korfhage as Vice-Chair.

Rebecca Haven moved and Roger Crabtree supported the motion to approve the Zoning Board of Appeals minutes of March 8. 2007.

Roger Crabtree moved and Rebecca Haven supported the motion to adjourn the Zoning Board of Appeals meeting at 7:35 p.m.
