MEETING
CITY OF WALKER
ZONING BOARD OF APPEALS
Thursday, May 10, 2007
7:00 p.m.

The meeting of the Zoning Board of Appeals was called to order by Robert Marz, Chairman at 7:00 p.m. at City Hall 4243 Remembrance Rd., N.W., Walker, Michigan.

Members present: Robert Marz, Chairman; Roger Crabtree; Charles Deshaine; Rebecca Haven; James Hickey; Tyler Korfhage; Randy Smith; and Beth Rogers. Also present: Jeff Nelson, Building Official and Tammy Friedman, Recording Secretary.

DECISION AND ORDER

Legal Description

Property located at 1101 Wilson, N.W., also known on the tax rolls as 41-13-19-126-002. Hearing requested by Sonja Forte.

The applicant’s request is to construct carports for Walker Meadow Retirement Community in the side and front yards instead of the required rear yard.

Finding of Facts

Robert Marz, Chairman reviewed the application and site plan submitted. He then informed the applicant that the Board was one member short and any motion for or against, and if the vote is 3 to 3, the motion will not carry. No other citizen appeared with respect to this request.

Ms. Forte stated that they felt the carports would be very beneficial to their residents. The adjacent property owner is aware of this because they have been gracious enough to pay for the carports.

Chuck Deshaine asked if the carports would be covered.

The applicant then showed pictures of the carports and what they will look like.

Jim Hickey asked the applicant if they were aware that the main driveway would be closed off?

The applicant replied that they are aware of that Ms. Forte went on to say that the driveway will be taken care of by the developer.

Motion

Jim Hickey moved and Tyler Korfhage supported the motion to grant the applicant’s request to construct carports for Walker Meadow Retirement Community in the side and front yards instead of the required rear yard.

The variance is necessary for the preservation and enjoyment of a substantial property right similar to that possessed by other properties in the same zoning district and in the vicinity. We have an aging senior population and this variance would allow us to reduce the risk of injury. The carports need to be located close enough to the building for safe access and not against the building which would obstruct views from the apartments.

The variance is necessary for the preservation and enjoyment of a substantial property right similar to that possessed by other properties in the same zoning district and in the vicinity. This type of construction will enhance the appearance of the property, allow car storage on existing parking space, and will help minimize noise and auto lights from the newly constructed adjacent business.

Authorization of the variance will not be of a substantial detriment to adjacent property and will not materially impair the intent and purpose of the ordinance or public interest in that the proposed carports are very attractive. They will also add covering to keep them all in good condition in a nice setting.

The condition or the situation of the piece of property or the intended use of the property for which the variance is sought is not of so general or recurrent a nature as to make reasonably practicable for the formulation of a general regulation. Due to the building setting, we would not be adding additional spaces, merely covering those that already exist.

Motion carried unanimously.

Chuck Deshaine moved and Roger Crabtree supported the motion to approve the Zoning Board of Appeals minutes of April 12, 2007.

Motion carried 6 to 0.

Roger Crabtree moved and Jim Hickey supported the motion to adjourn the Zoning Board of Appeals meeting at 7:20 p.m.

Motion carried 6 to 0.
