MEETING
CITY OF WALKER
ZONING BOARD OF APPEALS
Thursday, September 13, 2007
7:00 p.m.

The meeting of the Zoning Board of Appeals was called to order by Robert Marz, Chairman at 7:00 p.m. at City Hall, 4243 Remembrance Rd., N.W., Walker, Michigan.

Members present: Robert Marz, Chairman; Charles Deshaine; Tyler Korfhage; Roger Crabtree; James Hickey; and Randy Smith. Member absent: Beth Rogers.

Also present: John Stuyfzand, Building Department and Bonnie Antcliff, Recording Secretary.

DECISION AND ORDER

Legal Description

Property located at 2849 3 Mile Rd., NW also known on the tax rolls as 41-13-04-376-06. Hearing requested by Ivan Goolooze.

The applicant’s request is to expand a non-conforming single family use in an industrial zoned district by adding a 40 x 64 ft. pole building.

Finding of Facts

Robert Marz, Chairman reviewed the site plan and application submitted. He then read a letter from Kamps Pallets dated September 12, 2007. He stated that Planning Department says no on this request with no explanation. No other citizen appeared with respect to this request.

Mr. Goolooze stated that this building will have steel siding and will enhance the property. He went on to say that he had a car and a motor home that he wanted to store in this building.

John Stuyfzand stated that pole buildings do exist in the commercial zones. The intended purpose for this building is for residential use, therefore it would be built as a conforming residential use building. If it were to be converted, it would have to be made to conform to the use of the current zoning.

Roger Crabtree asked if there were any restrictions on size or height?

John Stuyfzand replied that the size and height meet the restrictions for a residential lot. The side yard setbacks are adequate and the design of the building meets the residential standards.

Tyler Korfhage asked where the driveway will be?

Mr. Goolooze replied it will come off of Peach Ridge. The driveway is already in. The doors will be on the north side toward the driveway. There will be no overhead doors facing 3 Mile Rd.

Chuck Deshaine felt it will be a good looking building and he sees no detriment here.

Motion

Tyler Korfhage moved and Jim Hickey supported the motion to approve the applicant’s request to expand a non-conforming single family use in an industrial zoned district by adding a 40 x 64 ft. pole building.

a. The variance is necessary for the preservation and enjoyment of a substantial property right similar to that possessed by other properties in the same zoning district and in the vicinity. The home was remodeled last year and single family homes are seldom found in industrial zones and would not be allowed today.

b. The variance is necessary for the preservation and enjoyment of a substantial property right similar to that possessed by other properties in the same zoning district and in the vicinity. Houses on 3 Mile Rd. in the industrial zone are, 2802 3 Mile, 2031 3 Mile, and 2025 3 Mile.

c. Authorization of the variance will not be of a substantial detriment to adjacent property and will not materially impair the intent and purpose of the ordinance or public interest in that there are industrial businesses on all sides and the pole building will match the colors on the house.

d. The condition or the situation of the piece of property or the intended use of the property for which the variance is sought is not of so general or recurrent a nature as to make reasonably practicable for the formulation of a general regulation. We see the need to control uses in the industrial district, but this single family home will be there for some time due to remodeling.

e. Does not apply.

Condition:

1. If this is changed in any way other than for residential use, it will have to meet the requirements for the industrial zone.

Motion carried 6 to 0.

Randy Smith moved and Jim Hickey supported the motion to approve the Zoning Board of Appeals minutes of August 23, 2007.

Roger Crabtree moved and Jim Hickey supported the motion to adjourn the Zoning Board of Appeals meeting at 7:30 p.m.

Motion carried 6 to 0.
