MEETING
CITY OF WALKER
ZONING BOARD OF APPEALS
Thursday, March 13, 2008
7:00 p.m.

The meeting of the Zoning Board of Appeals was called to order by Roger Crabtree, Acting Chairman at 7:00 p.m. at City Hall 4243 Remembrance Rd., N.W., Walker, Michigan.

Members present: Roger Crabtree; Charles Deshaine; James Hickey; Beth Rogers; John Tuffelmire, Alternate; and Brian Boelens, Alternate. Members absent: Robert Marz; Tyler Korfhage; and Randy Smith. Also present: Jeff Nelson, Building Official; and Bonnie Antcliff, Recording Secretary.

DECISION AND ORDER

Legal Description

Property located at 200 North Park also known on the tax rolls as 41-14-06-176-001. Hearing requested by CBS Outdoor.

The applicant’s request is to construct a billboard which will be approximately 65 ft. above grade at the billboard location and 35 ft. above the grade of I-96 instead of the average grade below the billboard site.

Finding of Facts

Roger Crabtree, Acting Chairman reviewed the application and site plan submitted. He went on to say that the Zoning Board of Appeals heard this application on June 22, 2006 and we granted the variance with the condition that the sign be a maximum of 65 ft. above the grade at the sign location.

Jeff Nelson stated that they did have a billboard close to this location and now they want to put up a new billboard. It is the same thing they asked for in 2006. They never put the sign up and they are back because the time has run out.

Mr. Hucel, CBS Outdoor stated that they had a delay because of securing DEQ permits which have been secured.

Some discussion ensued as there was a billboard in the area that was denied by the Planning Commission. This was not the same billboard.

Roger Crabtree stated that the applicant is asking the Board to reinstate the variance that was granted in June, 2006 for this billboard.

Motion

James Hickey moved and Charles Deshaine supported the motion to approve the applicant’s request to construct a billboard which will be approximately 65 ft. above grade at the billboard location and 35 ft. above the grade of I-96 instead of the average grade below the billboard site.

There are exceptional or extraordinary circumstances applicable to the property in question as to the intended use of the property that do not apply generally to other properties in the same zoning district. The billboard location is down in a hole.

The variance is necessary for the preservation and enjoyment of a substantial property right similar to that possessed by other properties in the same zoning district and in the vicinity. A billboard on this property close to this location had a variance for height and we were granted a variance on 6-22-06.

Authorization of the variance will not be of a substantial detriment to adjacent property and will not materially impair the intent and purpose of the ordinances or public interest in that this is a highly industrial/freeway location and there should be no detriment to the surrounding area.

The condition or the situation of the piece of property or the intended use of the property for which the variance is sought is not so general or recurrent a nature as to make reasonably practicable for the formulation of a general regulation, because building, light poles, and other equipment around this location are taller in this industrial area than in residential zoned areas.

Motion carried 6 to 0.

Motion

James Hickey moved and Beth Rogers supported the motion to approve the Zoning Board of Appeals minutes of January 10, 2008.

Motion carried 6 to 0.

Motion

Beth Rogers moved and John Tuffelmire supported the motion to adjourn the Zoning Board of Appeals meeting at 7:15 p.m.

Motion carried 6 to 0.
